
The Judicial Vetting Commission announces the completion of the evaluation of Judge Vasile Nogai, former President and Acting President of the Drochia Court. According to the report drafted by Panel D of the Commission, designated to conduct the evaluation, Judge Vasile Nogai does not meet the integrity criteria and, therefore, does not pass the external evaluation.
The report was transmitted today to the Superior Council of Magistracy (SCM), which is to examine the Commission’s findings and decide whether to accept or reject the recommendation of non-promotion. In line with the interpretation of the Constitutional Court, evaluation reports are not public at this stage. The only information available to the public is the evaluation outcome, published on the Commission’s website under the “Subjects” section.
The evaluation report becomes public after it is examined by the SCM and only after the expiry of the appeal period or following the issuance of a final decision by the Supreme Court of Justice.
Context of the evaluation
Panel D of the Commission, composed of members Marcel van de Wetering, Lilian Enciu, and Iurie Gațcan, evaluated Judge Vasile Nogai in his capacity as a court president. Over the past five years, he held the positions of President and Acting President of the Drochia Court.
The evaluation procedure was initiated in May of last year, when the judge was formally notified of the commencement of the verification process. Throughout the evaluation, the judge responded to multiple rounds of questions concerning financial and ethical integrity issues identified by the Commission.
These matters were examined during the hearing held in December, in which the judge participated. Additionally, at the judge’s request, third parties were heard in closed session.
