
Following the final decision delivered by the Supreme Court of Justice (SCJ) in the case concerning the examination of the appeal lodged by Grigore Dașchevici, former judge of the Central Court of Appeal, the Commission publishes its evaluation report.
By its final ruling, the Supreme Court of Justice dismissed the appeal filed by Grigore Dașchevici against the decision of the Superior Council of Magistracy (SCM), which had approved the Commission’s report finding that he did not pass the external evaluation.
Details of the evaluation
Grigore Dașchevici was evaluated in his capacity as a judge of the Central Court of Appeal. The evaluation procedure was carried out by Panel A of the Commission, composed of members Andrei Bivol, Lilian Enciu, and Lavly Perling.
Given that the legislation establishes different evaluation periods for the ethical and financial integrity criteria, the Commission assessed the subject’s compliance with these criteria for periods of 5, 10, and 12 years, respectively.
The Commission’s conclusions
The evaluation report finds that the subject does not meet the ethical and financial integrity criteria. The Commission identified two distinct grounds for non-compliance, and the evaluation procedure examined, inter alia:
According to the report, the recommendation of non-promotion could have been issued by the Commission on the basis of any of the identified grounds. The decision of non-promotion was adopted unanimously by the members of Panel A.
Effects of the decision
As a result of the final decision of the SCJ, Grigore Dașchevici is disqualified from holding the office of judge for a period of six years, starting from the date on which the decision of the SCM became final.
