Proposal for failure of the external evaluation for a judge of the Central Court of Appeal

The Judicial Vetting Commission has submitted today to the Superior Council of Magistracy (SCM) its report on the external evaluation of Judge Grigore Dașchevici from the Central Court of Appeal. As a result of the evaluation process, the Commission recommends that the judge fails the evaluation. According to the report’s findings, the judge does not meet the integrity criteria set forth in Law 252/2023, which served as the basis for the evaluation.

The SCM will review the submitted report and adopt a decision either accepting or rejecting the Commission’s recommendation. Until a final decision is rendered, the evaluation result is available on the Commission’s website under the “Subjects” section. The full report will be published within three days after the expiration of the legal period for contesting the SCM’s decision or, if applicable, following a final ruling by the Supreme Court of Justice in the event of an appeal.

Progress of evaluations at the Central Court of Appeal

Out of the 18 sitting judges of the Central Court of Appeal who have been subject to evaluation, 9 judges have received reports recommending promotion, while 7 judges received reports recommending failure of the evaluation. For the remaining two judges, the evaluation reports are currently being drafted.

Overall statistics

Since the beginning of its activity, the Judicial Vetting Commission has been tasked with evaluating 179 individuals, under the framework of the three laws governing the external evaluation process.

To date, the Commission has completed 69 evaluations, and 56 evaluations are in progress, including those concerning judges who currently hold or have held managerial positions within the judiciary in the last five years. 50 individuals have resigned or withdrawn from selection procedures so far, while 4 individuals had previously passed the pre-vetting thus falling outside the scope of the current evaluation.
