The Judicial Vetting Commission has completed the re-evaluation ordered by the Superior Council of Magistracy (SCM) regarding Judge Veronica Cupcea, Acting President of the Orhei Court.
According to the findings of the re-evaluation report, Judge Veronica Cupcea does not meet the statutory financial integrity criteria. Consequently, the Commission has recommended to the SCM that the judge not pass the external evaluation.
This is a preliminary outcome. As, pursuant to the applicable legal procedure, the Superior Council of Magistracy (SCM) will examine the findings set out in the re-evaluation report and decide whether to accept or reject the Commission's recommendation. The report was submitted to the SCM today for examination and decision and was simultaneously communicated to the judge evaluated.
At this stage, the Commission's report does not produce legal effects. These will arise only after the SCM adopts its decision.
During the initial evaluation, the Commission concluded that Judge Veronica Cupcea did not meet the integrity criteria and recommended that she not pass the external evaluation. The SCM subsequently ordered a re-evaluation of the case.
In accordance with the Constitutional Court's interpretation, both the initial evaluation report and the re-evaluation report will be made public upon the expiry of the time limit for challenging the SCM's decision or, where applicable, after the Supreme Court of Justice has delivered a final judgment.
