Commission’s findings in two reevaluation procedures ordered by the SCM

The Judicial Vetting Commission announces the completion of two reevaluation procedures ordered by the Superior Council of Magistracy (SCM), concerning judges Natalia Mămăligă and Petru Triboi. According to the conclusions included in the reevaluation reports, the Commission proposes the SCM that both judges pass the evaluation.

During the reevaluation of Judge Natalia Mămăligă, candidate for the Central Court of Appeal, the Commission confirmed that she meets the legal integrity criteria, consistent with the initial assessment. No new circumstances were identified to alter the previous conclusion.

During the initial evaluation of Judge Petru Triboi, Acting President of the Ungheni District Court, the Commission issued a conclusion of non-promotion. Subsequently, in the course of the reevaluation procedure, the Commission examined new factual circumstances submitted by the SCM, which had not been available for consideration at the initial stage. Following this supplementary assessment, the Commission determined that the judge meets the statutory criteria of financial and ethical integrity and recommended to the SCM that the judge pass the evaluation.

The reevaluation procedures focused exclusively on the aspects indicated by the SCM in the decisions by which the initial reports were rejected. The reports on both procedures were submitted to the subjects of evaluation and to the SCM for review and final decision.

At this stage, the Commission’s reports do not produce immediate legal effects. The SCM will decide whether to accept or reject the reports. The outcome of the reevaluations is available on the Commission’s website, and the reports will be published after the expiry of the legal appeal period or, if an appeal is filed, after a final ruling is issued by the Supreme Court of Justice.
