SCM accepted three evaluation reports and excluded a former judge from the Central Court of Appeal competition

The Judicial Vetting Commission announces that, during today’s meeting, the Superior Council of Magistracy (SCM) accepted three evaluation reports submitted by the Commission. The SCM approved the positive evaluation report for judge Elena Grumeza of the Northern Court of Appeal, the positive evaluation report for judge Alexandru Negru of the Chișinău District Court, who is a candidate for the Supreme Court of Justice (SCJ), and the negative evaluation report confirming that judge Oxana Mironov, also of the Northern Court of Appeal, did not pass the evaluation.

At this stage, the Commission has updated the “Subjects” section on its official website to reflect the evaluation results. The full evaluation reports will be published in accordance with the interpretation of the Constitutional Court—three days after the expiration of the deadline for challenging the SCM decisions, and with due regard for the protection of privacy and personal data.

In a separate decision, the SCM ruled on the Commission’s request to exclude the former judge Grigore Manoli from the competition for the Central Court of Appeal.

In November 2024, the Commission issued a non-passing evaluation report in the case of Grigore Manoli, pursuant to Law No. 65/2023 on the external evaluation of judges and candidates for the Supreme Court of Justice. The SCM accepted this report. Grigore Manoli subsequently challenged the Council’s decision before the SCJ, which dismissed his appeal.

As of the date the decision of the SCM became final, Grigore Manoli was released from judicial office and is prohibited from holding positions of public dignity for a period of 7 years. Accordingly, Grigore Manoli no longer satisfies the legal conditions for participation in the competition for a judicial position at the Court of Appeal and shall not be subject to evaluation by the Vetting Commission pursuant to Law No. 252/2023
