Judicial vetting: preliminary results for judges Angela Bostan and Vitalie Budeci

The Judicial Vetting Commission announces that it has completed the reevaluation of judge Angela Bostan of the Central Court of Appeal, as ordered by the Superior Council of Magistracy (SCM). Following the reevaluation, the Commission concluded that judge Bostan meets the integrity criteria and passes the evaluation. The report was transmitted today to SCM for review and adoption of a final decision.

The reevaluation of judge Angela Bostan focused exclusively on the issues identified by the SCM in its decision to reject the Commission’s initial report, which had recommended her promotion, and to order the resumption of the evaluation procedure. The reevaluation process included an additional hearing of the judge before the Commission’s plenary.

Also today, the Commission transmitted its evaluation report regarding judge Vitalie Budeci, from Chișinău Court (temporarily assigned to the Central Court of Appeal), who is a candidate for the position of judge at the Central Court of Appeal. According to the Commission’s conclusions, judge Budeci does not meet the integrity criteria and failes the external evaluation.

The Commission’s reports do not take immediate effect. The SCM will review the reports and adopt a decision on whether to accept or reject the Commission’s recommendations. The evaluation outcomes are available on the Commission’s official website, while the full reports will be published after the expiry of the legal appeal period or, in the event of an appeal, following the final ruling of the Supreme Court of Justice.

Since its establishment, the Judicial Vetting Commission has received 181 subjects for evaluation under the three laws regulating external evaluation:

64 - resigned or withdrew from competitions,

4 - had previously passed the pre-vetting evaluation,

94 evaluations and 1 reevaluation have been completed,

24 evaluations and 6 reevaluations are currently in progress.
