Reevaluation | Hearing of Judge Ion Bulhac from the Central Court of Appeal

Judge Ion Bulhac of the Central Court of Appeal was heard by the Judicial Vetting Commission as part of the re-evaluation procedure ordered by the Superior Council of Magistracy (SCM).

The re-evaluation focused on the considerations identified by the Superior Council of Magistracy (SCM) in its decision rejecting the initial evaluation report. The hearing addressed an issue of ethical integrity, namely the judge’s involvement in several cases examined by the European Court of Human Rights (ECtHR). The ECtHR cases were discussed in a closed session, as they had been grouped according to the relevant articles of the Convention, and some of the underlying cases remain pending. This portion of the hearing is therefore not included in the public recording.

Following the hearing, the Panel will adopt a report setting out its relevant findings, reasoning, and recommendation as to whether the judge should pass or fail the re-evaluation. The outcome of the re-evaluation will be made public, and the report will be submitted to the Superior Council of Magistracy.

📜The external extraordinary evaluation is carried out based on the following principles:

a) independence of the Evaluation Commission;

b) fairness of the evaluation procedure;

c) publicity of the acts issued in the evaluation process;

d) exceptional nature of the evaluation.
