Public hearing of the candidate for the position of SCJ judge Sergiu Stratan

Judge Sergiu Stratan of the Chișinău Court, Buiucani Office, is a candidate for the position of judge at the Supreme Court of Justice (SCJ) and is being evaluated by the Judicial Vetting Commission in accordance with Law No. 65/2023. As part of the external integrity evaluation process, the Commission invited him to a hearing.

The hearing was held in plenary session, in line with the legal procedures applicable to SCJ candidates. Judge Sergiu Stratan provided clarifications regarding certain financial and ethical integrity aspects, including the origin of funds used for the renovation of an apartment and the possible failure to pay taxes related to a capital gain.

Following the hearing, the Commission prepares a detailed report outlining the relevant facts, the reasoning behind its conclusions, and its proposal regarding whether the candidate passes the evaluation. This report is then sent to both the candidate and the Superior Council of Magistracy (SCM), which will examine the findings and issue a reasoned decision.

📜The evaluation of the Supreme Court of Justice judges and of candidates for the position of judge of the Supreme Court of Justice is carried out based on the following principles:

a) independence of the Evaluation Commission;

b) fairness of the evaluation procedure;

c) publicity of the acts issued in the evaluation process;

d) exceptional nature of the evaluation.
