SCJ Vetting: The first evaluation reports have been transmitted by the Vetting Commission to the SCM

The Vetting Commission has completed the evaluation regarding Aliona MIRON, acting judge of the Supreme Court of Justice (SCJ), and the candidates for the SCJ judge position, Sergiu BRIGAI and Viorica PUICA, and proposes the Superior Council of Magistracy (SCM) that the three subjects promote the external evaluation.

The evaluation reports, including relevant facts and the reasons underlying the conclusions of the commission members, along with all materials gathered in the evaluation, have been transmitted to the subjects and the SCM, as provided by Law 65/2023 and the Regulation of Organization and Functioning of the Commission.

SCM is set to examine the evaluation files received from the Commission and the results of the evaluation in a public session. Through a reasoned decision, the SCM will either accept or reject the evaluation reports. Also, SCM may only order the resumption of the evaluation once if it finds factual circumstances or procedural errors that could have led to a different outcome of the evaluation.

The Vetting Commission will publish its evaluation reports on the website www.vettingmd.eu within 3 days of the SCM's adoption of motivated decisions, respecting precautionary measures related to the protection of the privacy of the subjects and other persons involved in the process.

Background

Aliona MIRON, Sergiu BRIGAI, and Viorica PUICA have been evaluated by the Vetting Commission under the provisions of Law 65/2023 regarding the external evaluation of judges and candidates for the position of judge at the Supreme Court of Justice. The evaluation involves a detailed examination of their financial and ethical integrity. For the evaluation of ethical integrity, the analysis period is up to 10 years. The Commission verifies whether the subject has engaged in arbitrary behaviors or conflicts of interest incompatible with the held position.

For the evaluation of financial integrity, the analysis period is up to 12 years. The Commission verifies the subject's compliance with the tax and legal regime for declaring assets and personal interests, the manner of acquiring property or possession, as well as expenses related to the maintenance of such assets and sources of income.
